(hereinafter "Seller") regarding the goods presented by the Seller in its online shop.
(2) A consumer within the meaning of these GTC is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor their independent professional activity (§ 13 BGB).
(3) These GTC are exclusively addressed to consumers.
§ 2 Conclusion of Contract
(1) The product descriptions contained in the Seller's online shop do not constitute binding offers on the part of the Seller, but serve for the Customer to submit a binding offer.
(2) The Customer can submit the offer via the online order form integrated into the Seller's online shop. By clicking the button that concludes the ordering process ("order with obligation to pay" or a comparable clear formulation), the Customer submits a legally binding offer with regard to the goods contained in the shopping cart.
(3) The Seller can accept the Customer's offer within five days by:
- sending the Customer a written order confirmation or an order confirmation in text form (e-mail), or
- delivering the ordered goods to the Customer, or
- requesting payment from the Customer after the submission of their order.
If several of the aforementioned alternatives exist, the contract is concluded at the time when one of the alternatives occurs first. The period for acceptance of the offer begins on the day after the Customer sends the offer and ends with the expiry of the fifth day following the sending of the offer.
(4) When submitting an offer via the Seller's online order form, the contract text is stored by the Seller after the conclusion of the contract. The Customer receives their order data via e-mail.
(5) Before submitting the binding order, the Customer can identify and correct any input errors by carefully reading the order details on the screen, increasing the screen zoom if necessary, and correcting the order details using the usual keyboard and mouse functions.
(6) The German language is exclusively available for the conclusion of the contract.
§ 3 Right of Withdrawal
Consumers generally have a right of withdrawal. Further information on the right of withdrawal can be found in the Seller's cancellation policy (see separate cancellation policy).
§ 4 Prices and Payment Terms
(1) Unless otherwise stated in the Seller's product description, the prices indicated are total prices. Due to the application of the small business regulation according to § 19 UStG, no sales tax is calculated or shown.
(2) Shipping costs depend on the order value and are transparently displayed to the customer before completing the order process. Shipping is free for orders over 25 €.
(3) The Customer has various payment methods available for payment, which are specified in the Seller's online shop, in particular:
- Shopify Payments (credit card)
- PayPal
- Klarna (e.g., purchase on account, installment purchase – depending on availability)
(4) If prepayment by bank transfer has been agreed, payment must be made immediately after the conclusion of the contract.
(5) If a payment method via a payment service provider (e.g., PayPal, Klarna) is selected, their terms of use also apply, to which the Customer is referred.
§ 5 Delivery and Shipping Conditions
(1) The delivery of goods takes place by shipping to the delivery address provided by the Customer, unless otherwise agreed.
(2) Unless otherwise specified for individual goods, the delivery time within Germany is 2–5 working days.
(3) If the carrier commissioned with the delivery returns the goods to the Seller because delivery to the Customer was not possible, the Customer bears the costs for the unsuccessful shipment if they are responsible for the circumstance of non-delivery.
(4) If delivery does not take place due to the unavailability of the ordered goods, the Seller will immediately inform the Customer and immediately refund any consideration already provided.
§ 6 Retention of Title
The delivered goods remain the property of the Seller until full payment.
§ 7 Warranty / Liability for Defects
(1) The statutory liability for defects applies.
(2) Consumers are requested to complain about goods delivered with obvious transport damage to the deliverer and to inform the Seller thereof. Non-compliance has no effect on statutory or contractual claims for defects.
§ 8 Applicable Law
All legal relationships between the parties are governed by the laws of the Federal Republic of Germany, excluding the laws on the international sale of movable goods. For consumers, this choice of law only applies to the extent that the protection granted is not withdrawn by mandatory provisions of the law of the state in which the consumer has their habitual residence.
§ 9 Dispute Resolution
The European Commission provides a platform for online dispute resolution (ODR), which you can find at https://ec.europa.eu/consumers/odr/. We are not willing or obliged to participate in dispute resolution proceedings before a consumer arbitration board.
